1. Acceptance of these terms

This website at www.shadosecurities.com is operated by SHADO Securities (“SHADO”, “we”, “us” or “our”). By accessing or using the site you agree to these Terms of Use. If you do not agree, please do not use the site.

We may revise these terms from time to time. The version published here at the time of your visit applies, and the “last updated” date above records the most recent change. Continued use after a change constitutes acceptance of the revised terms.

2. Nothing here is a service contract

The content of this site is general information about our capabilities. It is not an offer, and submitting an enquiry does not create a client relationship or oblige us to accept an instruction.

Any engagement of SHADO for security consulting, investigations, background verification, security manpower or protection services is governed exclusively by a separate written agreement signed by both parties, together with its scope of work, service levels, commercial terms and confidentiality and data protection provisions. Where anything on this site conflicts with that agreement, the signed agreement prevails.

3. Not a security, legal or professional recommendation

Descriptions of services, methodologies, risk concepts and industry commentary on this site are provided for general information only. They are not a security assessment, a risk recommendation, or legal, regulatory or compliance advice, and they are not tailored to any particular site, organisation or threat picture.

Sound security decisions depend on a site-specific assessment of your environment, assets, people and threats. Do not act, or refrain from acting, on the basis of this site alone. Seek a formal assessment and qualified professional advice before making security, staffing, investigative or legal decisions.

4. Acceptable use

You may view, browse and print pages of this site for your own legitimate business use. You must not:

• Use the site for any unlawful purpose, or in breach of any applicable Indian law or regulation.
• Attempt to gain unauthorised access to the site, its servers, or any connected system, network or account; or probe, scan or test the vulnerability of any of them without our prior written permission.
• Introduce malware, or any code, agent or process intended to damage, disrupt, overload or impair the site or its infrastructure.
• Scrape, harvest, mine or systematically extract content or contact data from the site, or use automated means to access it in a way that imposes an unreasonable load.
• Submit false, misleading or impersonating information through our enquiry forms, or send unsolicited commercial messages through them.
• Copy, reproduce, republish, frame or redistribute site content for commercial purposes, or present it as your own.
• Misrepresent any association, endorsement or affiliation with SHADO, or use the site to imply that a security engagement exists where it does not.

We may suspend or block access where we reasonably believe these terms have been breached, and may report unlawful activity to the appropriate authorities.

5. Intellectual property

All content on this site — including text, page copy, layout, design, graphics, iconography, photographs, diagrams, the SHADO name, logo and brand marks, and the underlying code — is owned by or licensed to SHADO and is protected by copyright, trade mark and other intellectual property laws of India and applicable international treaties.

No licence is granted except the limited permission in section 4 to view and print pages for your own business use. You may link to our home page in a fair and lawful way that does not damage our reputation or suggest an endorsement we have not given. All other use requires our prior written consent, which you may request at info@shadosecurities.com.

Third-party names and marks appearing on the site remain the property of their respective owners and are used for identification only.

6. Accuracy and no warranty

The site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, conditions and representations, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We take care with what we publish, but we do not warrant that the content is complete, current or free of error, that the site will be uninterrupted, secure or free of harmful components, or that any statistic, capability figure or service description will apply to your circumstances. Content may be changed or withdrawn at any time without notice.

7. Limitation of liability

To the maximum extent permitted by applicable law, SHADO, its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for any loss of profit, revenue, business, goodwill, data, or anticipated savings, arising out of or in connection with your use of — or inability to use — this site or its content, whether in contract, tort (including negligence), statute or otherwise, and whether or not we were advised of the possibility of such loss.

Our total aggregate liability arising from your use of this site is limited to INR 1,000 (one thousand rupees). Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence. Liability arising from a service engagement is governed by the signed agreement for that engagement, not by this section.

8. Third-party links

The site may link to third-party websites, resources or social media profiles. Those links are provided for convenience only. We do not control, endorse or accept responsibility for the content, products, services, security or privacy practices of any third-party site, and your use of them is at your own risk and subject to their terms.

9. Privacy

Our handling of personal data — including data submitted through the enquiry form and operational data arising from our services — is described in our Privacy Policy, which forms part of these terms.

10. Confidentiality of enquiries

Please do not send sensitive, privileged or classified material through the website enquiry form or ordinary email. These channels are not secure and are not appropriate for case details, evidence or personal data about third parties. If your matter is sensitive, contact us and we will arrange a secure channel and, where appropriate, execute a non-disclosure agreement before you share anything further.

11. Indemnity

You agree to indemnify and hold SHADO harmless against any claim, loss, liability, cost or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the site, or your violation of any law or third-party right in connection with your use of the site.

12. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or with your use of this site (including non-contractual disputes), are governed by and construed in accordance with the laws of India.

The courts at our registered office location in India shall have exclusive jurisdiction over any such dispute, and you submit to that jurisdiction. This does not affect any different dispute resolution mechanism agreed in a signed service agreement, which governs disputes arising from that engagement.

13. General

• If any provision of these terms is held invalid or unenforceable, the remaining provisions continue in full force.
• Our failure to enforce any provision is not a waiver of it.
• These terms, together with the Privacy Policy, are the entire agreement between you and SHADO regarding use of this website.
• A person who is not a party to these terms has no right to enforce them.
